By the C/S the plaintiff seeks to delete the name of defendant no. 1 since she died on 29-07-2021 leaving behind the defendants no. 2 and 3 as her legal representative. The C/S is supported with death certificate issued by Kolhapur Municiple Corporation stating the date of death of Shanta Kamlakar Sakhardande as 29-07-2021 and also by the plaintiffs affidavit in support. The defendants no. 2 and 3 despite service of the present C/S didnt reply thereto. In this view of the matter I do not find any justification to disallow the present C/S. Hence, the C/S stands allowed. The name of deceased defendant no. 1 be deleted from the cause title of the suit. The plaintiff to carry out the amendment in the plaint accordingly by next date.
