   Ld. Adv. appearing on behalf of respondent No.1 submits that admittedly the deduction from the salary is not made pursuant to the order of the Estate Officer but at the instance of officer other than Estate Office the amount was deducted from the salary of appellant and the respondent No.1 will return the amount deducted from the salary of appellant within four weeks from today.
    She also submits that this statement is without prejudice to the right of the respondent No.1 to proceed for eviction through Estate Officer in consonance with the provision of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971. The statement is accepted.
   The advocate for the appellant submits that appellant will not claim any interest on the amount deducted.
  In view of this the appellant withdraws the application for condonation of delay for filing appeal alongwith memo of appeal and the stay application as well.
