Heard Adv. for plaintiff.  He prays for interim relief.  He would submit that the defendant is owner of the floor mill situated at GNMCB-63, Balaji Nagar, Khambadevi Road, Dharavi.  Plaintiff is running the floor mill from the ground floor of the suit premises and residing along with his family on the upper floor.  The licensing authority has issued shop and registration certificate in the name of Asha Floor Mill in the name of defendant. The plaintiff is running the floor mill and depositing all the charges with concerned authority.  He has placed documents to that effect.
The deft. was present.  He sought time.  The plaintiff has filed his Adhar Card and of the family of his brother Rajendra Singh.  The plaintiff has filed other documents i.e. report of the BEST for testing of meter and other report wherein he has been shown as user.
At the outset, the plaintiff claimed to be in possession and residing at the first floor but his address in the Adhar card is different from that of the suit premises.  When the plaintiff is running the floor mill then the license prima-facie ought to have been issued in the name of the plaintiff.  But, all the documents prima-facie appear to be in the name of defendant.  In certain documents, plaintiff is shown as user that does not mean that at this initial stage, the plaintiff is alone running the floor mill and entitled for ad-interim relief.  Hence, plaintiff has not made out any case for ad-interim relief.  Therefore, it is expedient to pass the following order.
ORDER
1.   Ad-interim relief sought by the plaintiff is rejected.
