tendered draft NM with affidavit seeking to vacate the order
dated 20.04.2017 whereby the NM No. 1487/2015 was
made absolute by temporarily restraining the defendant
corporation from the acting upon the impugned notice and
order till disposal of the suit. Perused the copy of order dtd.
10.12.2018, passed by the Hon&amp#039ble High
Court (Coram - Ranjit More and Revati Mohite Dere, JJ.) in
W.p. no. 1037/2018 whereby the statement of ld. Counsel
for defendant corporation was recorded to the effect that
corporation would move an application for vacating the
interim stay, within four weeks from 10.12.2018.
Accordingly leave to register the NM is granted. Copy
served on Adv. Puranik. Thereafter, the defendant
corporation took out NM No. 325/2019 for expeditious
hearing of the suit on 15.01.2019. Accordingly on
24.01.2019, issues are framed and the matter has been kept
for filing list of witnesses and affidavit of evidence of
plaintiff today. In view of the same the NM No. 325/2019
for expeditious hearing is disposed off. Adv. Puranik
seeks time to file reply to NM taken out today, time is
granted till 14.02.2019. Adjd for NM reply and evidence of
plaintiff to 14.02.2019.
