def. no. 4 and Adv. Bhushan for plaintiff on NM no. 200 of
2018. Perused the affidavit and reply and the order dtd.
19.12.2017 by which the NM No. 4256 of 2016 was
dismissed. The ld. Adv. For def. no. 4 submits that at the
relevant time the plaintiff was not able to attend the court as
he was busy in marriage ceremony in his family and his
advocate was not able as shifting work was going on at his
place. Adv. Bhushan submits to pass necessary orders. Adv.
Rawade holding for Adv. Dhumale submits to the orders of
the Court. Considering the submissions, it is necessary that
NM No. 4256 of 2016 should be decided on merits.
Therefore the following order is passed. ORDER 1. NM
No. 200 of 2018 is made absolute in terms of prayer clause
(a) and (b), with a further direction to pay/deposit costs Rs.
300/- each for plaintiff and defendant no. 1 within a period
of one week from today.
