date. Adv for plaintiff submits that NM be heard alongwith
the suit. In the present matter plaintiffs evidence already
filed as it was ex party suit. Adv for the def strongly
objected to heard the NM alongwith the suit. She submits
that earlier there was no any ad interim order in the 2015
plaintiff filed another suit in which the ad interim granted
and also filed NM in the present suit for the same relief.
Thereafter plaintiff withdraw that suit and court granted ad
interim in the present matter. This is 2010 year matter, and
evidence of plaintiff already filed. The def has filed NM for
taking the W.S on record. As it is 2010 matter and evidence
also filed on record therefore NM shall be heard alongwith
the suit. Protection granted to the plaintiff till disposal of
the suit. Plaintiff has given no objection to take up the
written statement of deft on record. In view of the said no
objection, N/M No. 198/18 is disposed off. W/st. taken on
record. As the Court is going to hear N/m alongwith main
suit hence, application Exh. 21 is disposed off accordingly
and the matter is expedited by this Court.
