ORDER BELOW CHAMBER SUMMONS NO.101/18
1. Plaintiff has taken out this Chamber Summons for amendment
to carry out new address of the plaintiff in the cause title of the plaint. It
is pertinent to mention here that as per the affidavit filed by the
plaintiff, on record the said Chamber Summons was served upon the
defendants but they have not filed the reply.
2. Heard to the learned advocate for the plaintiff. It appears that
the plaintiff wants to carry out the amendment in the title clause
regarding the address of the plaintiff/Company, as it is transferred from
Andheri (East) to Dahisar Check Naka, Post office Mira Road, Mumbai.
Thus, considering the nature of proposed amendment, the interest of
justice requires to allow the plaintiff to amend the cause title of the
plaintiff. In the result, following order:
: ORDER :
1. Chamber Summons No.101/2018 is allowed.
2. The plaintiff is directed to carry out the proposed amendment in
the cause title of the plaint on or before the next date without fail.
3. Chamber Summons No.101/2008 is disposed of accordingly.
