In the above circumstances, it will be just and proper to transfer the matter to C.R.No.8 where the matter has been argued at length. Hence I pass following order.
1.Suit No.500/2008 be withdrawn from C.R.No.5 and transferred to C.R.No.8.
2.The application is accordingly disposed off.
