Order below Exh-1 Authorized representative of decree holder
and his advocate is present. Judgment debtor in person
present. They have submitted that matter is settled between
them as per settlement agreement at Exh-7. Both parties are
verified with terms and conditions of settlement agreement at
Exh-7. They have admitted and agreed for the terms and
conditions of settlement agreement. Authorized representative
of decree holder has submitted that, decree holder company
has accepted and agreed an amount of Rs. 18,00,000/- towards
full and final settlement. Decree holder company does not
want to proceed with the matter and wants to withdraw
Execution proceeding. Thus, in view of submissions by both
the parties and settlement agreement at Exh-7, it is necessary
to dispose of the matter. Hence, I proceed to pass following
order Order 1. Execution Application No.515/2017 in Sum.
Suit No.1282/16 is disposed of as withdrawn, in view of
settlement agreement at Exh-7. 2.Pending Chamber summons
No.3027/2024 is disposed of, as Execution proceeding is
withdrawn.
