Heard advocate for plaintiff and defendant on CS no.1267/2023 and CS no.1268/2023. These Chamber Summons are taken for again serving CS 93/2020 and CS 94/2020 on proposed LR’s of defendant nos.04 and 13. though Adv. Narayanan for defendant nos.16 and 17 pointed put various clause in Airway bill and tracking report as well as conduct of plaintiff is not taking proper steps promptly by the plaintiff for serving Chamber Summons on proposed LR’s, but the fact remains that proposed LR’s are necessary party to decide the suit. Therefore, CS no.93/2020 and CS no.94/2020 needs to be duly served on proposed LR’s. At the most cost can be saddled on plaintiff for not taking proper steps while allowing CS no.1267/2023 and Cs no1268/2023. With these reason I passed following order.
Common Order:
1) CS no.1267/2023 and CS no.1268/2023 are allowed in terms of prayer clause (a).
2) Plaintiff is permitted to serve CS no.93/2020 on LR’s of defendant no.04 and CS no.94/2020 on LR’s of defendant no.13. Through courier service which is available for service at abroad at the residential addresses of proposed LR’s subject to cost of Rs.1,500/- to be paid to DLSA Mumbai within two weeks.
3) Plaintiff to send the envelops of Chamber Summons within two weeks through courier and no time will be extended at any cost. On next date plaintiff shall submit receipt of courier sending the envelops to proposed LR’s in the court.
4) CS no.1267/2023 and CS no.1268/2023 are disposed off accordingly.
On oral request of adv. for plaintiff matter is fixed on 25.10.2023.
