1. Plaintiff has filed instant Notice of Motion seeking temporary
injunction against the defendant from creating third party interest
in the suit property.
2. The motion is opposed by the defendant by filing say.
However, the Ld. Advocate for the defendant on instruction, made
a statement that they will not create third party interest till the
decision of this suit. In my view, the aforesaid undertaking given
before the court would suffice the purpose of plaintiff and Notice
of Motion can be disposed of accordingly. Thus, in view of the
