Plaintiff has filed NM alongwith the suit for injunction. Adv
of MCGM strongly opposed the NM orally. However Adv
of BMC submitted that the court may issue directions to
take action as per law against the person who keeps or will
keep alleged Bakda (bench) in front of shop of plaintiff.
Adv of plaintiff is satisfied with said submission of BMC
and consented to dispose of suit and NM accordingly.
Hence in the interest of justice following order is being
passed by considering peculiarities of the matter- ORDER
1. Defendant/MCGM is hereby directed to take action as
per law if any person keeps any temporary stall/Bakda in
front of plaintiff&amp#039s shop premises being Shop
No.2 situated at 22/24 Narayan Dhuru Street, Jamat
Building, Mandvi Division, Mumbai by following due
procedure of law, as and when such complaint will be made
by plaintiff in writing in that regard. 2. Hence said NM
No.196/2018 and said Suit No.2712/2017 stands disposed
off accordingly. 3. Authenticated copy of todays roznama
be given to parties, if requested.
