ORAL ORDER
This notice of motion is taken out by the defendant for
condoning the delay and taking the written statement on record. It is
supported by an affidavit being executed by Vice president of defendant
Rupa Miranda. The main suit is for renewal of five fixed deposits.
Plaintiff has not filed reply to this notice of motion.
2. I have heard learned advocate of both the sides.
3. The defendant is ready to contest the suit on merits. In my
opinion, considering the nature of the suit , one opportunity needs to be
granted to defendant/ bank for filing written statement on record. Even

otherwise, it is submitted that the written statement is ready in all
respect. Hence for fair trial and proper adjudication of the case and
further in the interest of justice , I pass the following order.
ORDER
1. Notice of motion no.195/18 is allowed and made
absolute in terms of prayer clause (a) with a
specific conditions that the defendant shall file the
written statement today itself on record.
2. Written statement so filed be taken on record and
it be marked as Exhibit3. Copy served to other
side.
2. Notice of motion is disposed of accordingly.
