Hiremath for plaintiff Defendant in person ORAL ORDER This application is preferred by the defendant with a prayer that the plaintiff be ordered to pay Rs.22.75 crores in favour of Reform India Current Account General, Bank of India and Foreign Bank by the plaintiff to raise Overseas Investors from Paris, London, New York besides Singapore urgently. The second prayer in the application is for providing necessary care and protection of the defendant to get medical treatment and Global -- 1 of 3 -- 2 Order on Exh.14 in Suit no.632020 Customers Centre in Trident at Nariman Point Mumbai. 2. The application is not supported by an affidavit nor it is in the prescribed form as per The Bombay City Civil and Sessions Court Rules'1948. The application is silent under which provisions of law, it is to be considered. On those grounds itself, this application is liable to be dismissed. 3. The defendant has filed the say on affidavit being executed by Mr. R . Krishnamurthy. I have heard both the sides. During argument the defendant did not pointed about the nature of application and its provision. The amount of relief claimed otherwise also is beyond pecuniary jurisdiction of this Court. The application is vague. The main suit is for injunction under Specific Relief Act. Upon reading the application its very difficult as to what defendants want to convey. If the defendant has any claim, he can very well file a separate suit but he cannot apply in the way this application is preferred. Therefore in my opinion, for aforesaid reasons, the application is liable to be dismissed. Hence, I pass the following order: ORDER Application Exh.14 stands dismissed. Cost in cause. (Kishore M.
