Perused the application and say. Heard both the sides.
The prayer in this application for dismissal of suit. Application
with similar prayer is already rejected. The application is neither
supported by an affidavit nor is in the mandatory format provided
under the The Bombay City Civil Rules and Sessions Court Rules'
1948. On that ground itself, this application is liable to be
dismissed.

2. The reply to this application is an affidavit being
executed by Mr. R. Krishnamurthy, for the plaintiff. The
application is vague and therefore on that ground also it is not
maintainable. As per order in notice of motion the defendant is
restrained from making any defamatory statements and making
any communication to functionaries of the plaintiff. The review
petition no. 28/20 is also rejected. The defendant has not paid the
costs as ordered previously. The defendant has also not explained
under which provision of law such application is to be entertained.
3. In my opinion, for the aforesaid reasons and as the
application is devoid of merits, it is liable to be rejected.
Accordingly, I pass the following order.
ORDER
Application Exh.12 is rejected.
Cost in cause.
