ORAL ORDER
1. Today, plaintiff Smt.Deboshri Chitta Gaine alongwith
advocate Mr. Azharuddin Khan I/b Adv. Shohil M. Gulabani are
present before Court. Defendant also filed say on withdrawal
application. Plaintiff Smt. Deboshri Chitta Gaine admits
contents in the application and also submits that she want to
withdraw present suit unconditionally on the ground that in
A.O.No.574/2023 with Interim Application No. 13630/2023,
appellant (original plaintiff) and respondent no.2 arrived at
amicable settlement before Honourable High Court of
Judicature Bombay. In the said appeal before Honourable High

Court of Judicature Bombay, plaintiff/appellant undertake to
withdraw present suit. She also filed photocopy of Aadhar card
in support of proof of identity. Defendant/BMC gave no
objection for withdrawal of present suit.
2. As per averments in the application plaintiff seeks
permission to withdraw present suit on the ground of amicable
settlement before Honourable High Court of Judicature Bombay
in A.O.No.574/2023 with Interim Application No. 13630/2023.
Hence, considering the grounds mentioned in the application
and in view of Order XXIII Rule 1 and 2 of the Code of Civil
Procedure I proceed to pass following order.
ORDER
1. Plaintiff is permitted to withdraw L.C. Suit No. 238 of
2020 Smt. Deboshri Chitta Gaine V/s. The Mumbai
Municipal Corporation of Gr.Mumbai is granted.
2. Necessary order is passed below Exh.1
