O R A L O R D E R Read the application. 2 By the present application, the applicant seeks transfer of Suit No.4283/09 from C.R. no.15 to C.R. no.31 where Suit No.7177/01 is pending on the ground that both suits should be decided by one and the same court. 3 In view of in the case of Dadaji Dhackjee & Co. Ltd. V/s. Neelam V. Rajani and Ors. reported in 2016(1) ALL MR 426 and in case of Smt. Manaharbala Jeram Damodar -- 1 of 4 -- 2 TA14.20 & anr. V/s. Prabhudas Damodar Kotecha & Ors. reported in 2001(3) ALL MR 230 it has been held that in view of provision of Section 24 of Code of Civil Procedure this court not being a Principal Court of original justifcation, has no power to transfer any civil proceedings from one court to another on the judicial side. 4 Even otherwise from Case Information System (CIS), it is noticed that both suits are lying in C.R. no.13 i.e. in one and same court. Therefore, the application is not maintainable. Thus, even on administrative side, no case is made out. 5 Hence, I proceed to pas the following order: O R D E R T.A.
