Exh.2- Application for withdrawal of suit, with permission to file fresh suit. It is strongly objected by ld adv. MCGM.
In view of speaking order issued by the MCGM, Plaintiff intend to file fresh suit. It is to note that draft ch/s is already on record, by which impugned amendment can be carried out in present suit.
It is allow to withdraw the suit, subject to cost of Rs. 3,000/- be credited to the office of MCGM within a week. Upon depositing said cost, plff is permitted to file fresh suit. Hence, suit is disposed of along-with draft NM and draft Ch/s. It be register for statistical purpose.
