ORDER IN CH/SUM NO.84/2020
Heard. The Ld. Counsel for the plaintiff submitted that plaintiff and deft. no.3 have arrived at
settlement. The proposed deft. no.4 is Director of deft. no.3 and proposed deft. no.5 is brother of
deft. no.4 who is occupant of suit premises. He would submit that the parties have drawn consent
terms and in order to avoid any future complications, the proposed deft. nos.4 and 5 be added as a
party. The Ld. Counsel for deft. no.3 submitted that deft. no.3 has no objection for the same. Even,
the counsel for proposed deft. nos.4 and 5 is present. He submitted that proposed deft. nos.4 and 5
also do not have any objection for adding them as a party.
It appears from the submission canvassed by the Ld. Counsel for plaintiff that the matter is settled
between the parties. The rights of the property is vested with deft. no.3 and also with proposed deft.
nos.4 and 5 and therefore, if any settlement occurs between the parties in a suit, then they should be
party to the suit. Considering the submission made by the rival parties, it is just and expedient to
consider the present Ch/sum, hence the following order.
ORDER
1. Ch/sum No.84/2020 is made absolute in terms of prayer clause (a).
2. Plaintiff to carry out necessary amendment within a period of 14 days from today.
3. Ch/sum No.84/2020 is disposed off accordingly.
