Following Order is passed in NM No. 3247/2022.
01.	By this NM, defendant Nos. 5, 6 and 7 prayed for dismissal/ rejection of the suit against them, as it has become infructuos. They contended the soak pit, which existed earlier in the society campus was taken away because of road winding and as such, it was to be shifted. The similar was the position with the said septic time and its shifting was done by the contractor of defendant No.1. Likewise, they dealt with the allegations of illegal godown in their reply and the construction is complete. Further, the Occupation Certificate is already issued by defendant No.1 and therefore, the suit prayers do not remain for consideration. Having considered their submissions, it is notable that the suit is filed for quashing the Commencement Certificate and Stability report, along-with mandatory injunction as regards the soak pit and septic tank. Needless to say that as the suit is still at initiate stage, the contentions of these defendants, raised in their written statement, would require the trial. Specially when, the same are not readily inferred. On this background, on the basis their defence, it can’t be held that the suit has become infructous. Being so, I am of the opinion that this NM can not be considered at this juncture in proper prospect and hence, as of now, it needs to be disposed of as filed in view of the following Order :
01.	Notice of Motion No. 3247/2022 stands filed.
02.	Notice of Motion No. 3247/2022 is, accordingly disposed of.
