This Notice of Motion is taken out by defendant to condone
the delay and for taking his written statement on record.
2. Defendant submitted that writ of summons was served by
plaintiff on 27.10.2017. He appeared before this court on 13.11.2017.
Thereafter he became sick and could not engage the counsel. There was
delay of 47 days in filing the written statement.
3. Upon considering the hearing the delay of 47 days without
stretching issues and to grant opportunity to the defendant to file the

written statement by imposing costs. Accordingly, I pass the following
order.
: ORDER :
1. Notice of Motion No.168 of 2018 is made absolute in terms
of prayer clause (a).
2. Defendant is directed to pay the cost of Rs. 1,000/ to the
plaintiff on or before next date.
3. After payment of cost, written statement be taken on record.
