 Perused the application and say of defendant/MCGM. The notice of motion taken out by the plaintiff in this suit has already been dismissed by this court and appeal against the said order is also dismissed by the Honble High Court. Another notice of motion taken out by the tenants in Suit No. 62/2022, court has dismissed it vide order dated 11.06.2026. When the notice of motion taken by the landlord and tenants are dismissed, it is the prerogative of defendant/MCGM when and how disputed structure should be demolished. In view of the aforesaid facts I do not find any substance in the application as it has devoid of merits so, accordingly rejected.
