According to defendant No.1 due to outbreak of Covid-19 she was unable to file the written statement within time. She relief on judgment of Hon\''ble Supreme Court  in Suo-motu Writ Petition No.03/20 whereby period of limitation from 15.03.2020 to 28.02.2022 has been excluded. According to her there is delay of 25 days. After the exclusion of time, since 01.03.2022 till the date of filing of this motion, the period of delay will be near about five months. It is the contention of defendant No.1 that since 20 June till 3 July 2022 she was not feeling well. I am not agree with the plaintiff\''s contention that the defendant No.1 will not be benefited by the exclusion of time directed in the Suo-motu Writ Petition No.03/20. As the period of limitation has been excluded therein and also considering the defendants contention about illness, I am of the view that delay shall be condoned. However, it shall be subject to costs. Hence, I pass the following order.
ORDER
1. Notice of Motion No.3082/2022 is allowed subject to costs of Rs.1,500/- (Rupees One Thousand Five Hundred only).
