On perusal of the record and proceeding, it is found that the suit is instituted in the year 2019. More than three years have been elapsed, but suit summons is not yet served on defendant. On 15.12.2022, by taking the note of continues absence of the plaintiff, it was observed that if the plaintiff failed to take steps, suit would be dismissed and then the suit was adjourned to 04.03.2023 and thereafter, to 09.06.2023, 06.09.2023 and then, lastly to 05.12.2023 i.e. today. Despite clear warning to the plaintiff on 15.12.2022, the plaintiff failed to appear before the court and to take steps. Today also, neither plaintiff nor its counsel are present.
