From the perusal of the record, it appears that  the postal receipts and the postal packets containing the endorsement of the postal employee , the defendant no. 1 Simpy Akshay Softa is seen to have left the address stated on the postal packet Exh. C where as the defendant Mrs. Neeru wife of Subhash Sharma is set to have been intimated by the postal employee. The service of the writ of summons and the other documents accompanied therewith contained in the same is therefore deemed to be served upon the defendant no. 2. However from the endorsement of the postal employee appearing on postal packet Exh. C it cannot be informed that the defendant no. 1 is deemed to have been served with the writ of summons and the document accompanied therewith. The plaintiff will have to take appropriate steps for serving the defendant no. 1 with the writ of summons and the necessary documents. Since the defendant no. 2 did not enter appearance in the matter. The suit shall proceed ex parte against defendant no. 2.
