Perused the application and the copy of consent terms filed vide
Exh. 7. Deft has given no objection for withdrawal of the suit.
The dispute herein was between husband and wife and it is
submitted that they have arrived at mutual settlement in a
petition before family Court. On perusal of consent terms
specifically para no. 6, 7 and 9 which is filed along with
application Exh. 7, in my opinion permission can be granted to
withdraw the suit. Application Exh. 6 is allowed and disposed of.

In view of order below Exh. 6 suit stands disposed of as
withdrawn. Case papers be filed. Court fees if any be refunded
to the pltff as per rules.
