2 The present application is filed by the applicants to transfer
suit no.2933 of 2018 pending in C.R. No.4 to C.R. No.3 and to club the
same with Suit No.700 of 2018.
3 It appears that the plaintiffs have filed suit against the
defendant praying that defendant should not create any third party right in
the suit premises viz. Room no.3/1/16, V.P. Nagar, BBlock, Dr.Annie

Besant Road, Worli, Lotus, Worli, Mumbai18 till final disposal of the suit.
The defendant has also filed suit against the plaintiffs for the same relief.
4 Ms.Vaibhavi Pawar, learned counsel for the plaintiffs,
submitted that in both the suits, the parties are common. The pleadings
are also identical.
5 Mr.Vishan Rathod, learned counsel for the respondent, in his
reply stated that the defendant has no objection to club both the matters.
6 In view of above, I pass the following order:
O R D E R
Transfer Application No.8 of 2019 is allowed.
Suit No.2933 of 2018 pending in C.R. No.4 stands
transferred to C.R. No.3 for disposal in accordance with law.
Both the courts be informed accordingly.
