ORAL ORDER
This notice of motion is taken out by the defendant for
condoning the delay and filing written statement on record. It is
supported by an affidavit.
2. Heard both the sides.
3. There is fourteen days delay in filing written statement.
The learned advocate for the defendant submitted that the written
statement is ready in all respects and it can be filed on record today
itself. Considering the fact that the written statement is ready, the delay
can very well be condoned in the interest of justice, so that the matter

can be proceeded on merits. Hence I pass the following order.
ORDER
1. Notice of Motion no. 98 of 2018 is allowed and
made absolute in terms of prayer clause (a) and (b).
2. The written statement filed by the defendant be
taken on record and it be marked as Exhibit2.
3. Notice of Motion is disposed of accordingly.
