ORDER
Read the averments in affidavit filed along with
chamber summons. Perused the reply filed by defendants overleaf.
2. This Chamber summons is taken out by plaintiff
praying for amendment in plaint of L.C. Suit No.117/2020.
3. Heard both learned advocates. Perused the proceeding.
Plaintiff in this chamber summons is asking for amendment in
plaint to bring on record the subsequent event of speaking order
passed by defendant corporation dated 10.01.2020. Plaintiff is
intending to aver pleadings with respect to same in body of plaint
& prayer with respect to this speaking order dated 10.01.2020.
4. The amendment sought by plaintiff is formal, not
changing the nature of suit. No prejudice will be caused to
defendants. Therefore, in the interest of justice, the prayer in
chamber summons of plaintiff deserves to be allowed.
Consequently, I proceed to pass following order.
ORDER
1. Draft Chamber Summons moved by plaintiff is hereby
allowed.
2. Plaintiff shall carry out proposed amendment within
stipulated time.
3. Costs in cause.
4. Chamber Summons No.2102/2018 is accordingly disposed of.
