Said NM is pending for hearing since long.
Advocate for the applicant in the said NM had claimed time
on 25.04.2019 to make submission about maintainability of
NM for impleading the applicant as party deft to the suit. As
nobody is present for the applicant today also, said N.M.
No.4581/2018 is dismissed in default for want of prosecution.
Roznam dt.12.11.2018 shows that plff had obtained leave
to register N.M. and leave was accordingly granted. The draft
NM tendered on that day is available on record and it is yet
not got registered by the plff. As nobody is present for the
plff today also, said draft NM is dismissed in default for want
of prosecution. It be got registered for statistical purposes.
Likewise, roznama dt.11.12.2018 shows that leave was
granted to deft to register N.M. It appears that deft has got
said NM registered as NM No.121/2019 but said registered NM
is not tendered in the Court till date. As nobody is present for
the deft today also, N.M.No.121/2019 is dismissed in default
for want of prosecution. In the result, suit to proceed without
WS against the deft.
Matter is adjd. for evidence without WS to 14.12.2021.
