Heard Ld. Counsel of both the parties on CS.
The plaintiff by way of this CS, desires to amend the plaint and to add pleading which according to him, arose in view of the subsequent event as stated in his CS. Plaintiff wants to add the pleading to his plaint as per schedule annexed to the CS. Defendant strongly opposed the same on the ground that the plaintiff did not inform the defendant about pendency of any proceeding before the Court of Small Causes.
I have considered the submissions. The suit is at its initial stage. The trial is yet to be started. Hence no prejudice will be caused to defendant, if the plaintiff is allowed to amend the plaint. Defendant will get chance for consequential amendment to the WS.
Chamber Summons is made absolute in terms of prayer (a)
The amendment be carried out within one week and amended copy be supplied within one week.
