1.     The plaintiff filed application for extension of ad-interim protection for period of 6 weeks. The defendant/ Corporation opposed application stating that this Court has rejected ad-interim and as such extension of ad-interim protection amount to granting ad-interim relief.
2.     The plaintiff intends to challenge order of dismissing N/M before Hon\''ble High Court. The appeal is the statutory right of the party who is aggrieved. It is submitted that if ad-interim protection is not extended, there is possibility of demolition of structure and purpose of filing appeal will be frustrated. Perused application and reply filed by corporation. Heard advocate for the parties. Plaintiff filed the application for extension of interim protection. It is matter of record that NM no. 464/2020 has been dismissed on 24.02.2023. As per order below Exh-8 interim protection was extended for 3 weeks. It is stated that plaintiff has received copy on 08th of March. It appears that plaintiff has filed AO before Hon\''ble High Court on 23.03.2023. The interim protection was extended for period of 3 weeks from 24.02.2023 as such the period of 3 weeks completed on 17.03.2023. Thus there is no interim protection as on today. The plaintiff has preferred appeal before Hon\''ble High Court therefore the application for extension of interim protection cannot be granted, hence I pass following order.
ORDER
