This is a notice of motion submitted by defendant No.1
bank to setaside the order of exparte hearing, passed by this court
dated 03.03.18.
2. Heard learned advocate Mrs. Don for defendant No.1.
3. Perused reply submitted by plaintiff. Heard learned
advocate Mr. Shailedra Singh for plaintiff. It is strongly registed.
4. There are 05 dates over after order of exparte evidence
came to be passed this court. However, thereare sufficient grounds
mentioned in para no.03 of motion, in respect of service of summons
served on the defendant no.1 bank. It would be appropriate to decide

the matter on merit.
5. Hence, Notice of motion is allowed subject to cost of
Rs. 1500/ be paid to plaintiff. Hence the order.
ORDER
1. Notice of Motion No.98 of 2019 is allowed, subject to cost of
Rs. 1500/ be paid to plaintiff on or before next date.
2. Upon deposition of aforesaid cost, the written statement of
defendant no.1 be accepted.
3. The Notice of Motion No. 98 of 2019 is disposed of accordingly.
