As per the order it is crystal clear that summons were not duly served to the defendant and therefore, the plaintiff has tendered Chamber Summons and accordingly leave is granted to register the Chamber Summons. In view of order dated 27/2/2019 Ld.Counsel for plaintiff tender registered Chamber Summons No.23 of 2019 to the Court. Chamber Summons No.23 of 2019 is kept on board on stage of argument. However, office of the City Civil Court, issue writ of summons and Ld.Counsel for plaintiff published the same in local newspaper and -- 1 of 2 -- 2 tender affidavit of service on court record. It means the office of City Civil Court issue writ of summons without verify the order of Chamber Summons No.23 of 2019 but it is true to say that the plaintiff has rightly published summons on local newspaper and therefore, summons is already published in local newspaper, therefore, Chamber Summons No.23 of 2019 is seems to be infructous.
