Heard Ld. counsel for both the sides regarding grant of ad-interim relief. Ld. counsel for plaintiff submitted that this court has granted interim relief in similar matter Suit no. 193/20 on 22.01.2020 against the defendant not to create third party interest in the suit property. The similar order passed in this case no prejudice will be caused to the defendant.
Ld. counsel for defendant has strongly objected the grant of interim relief as prayed for on the ground that pleadings are complete, there is no urgency, defendant has raised objection as to the jurisdiction of this court by para 4 of WS and submitted that the NM be heard in regular course.
After hearing both the sides, I find that as a pleadings are complete and there is objection to the jurisdiction of the court, no interim order can be passed at this stage. Motion can be heard on merit on any early date convenient to the parties.
