The plaintiff apprehends the creation of third party rights by the defendant, unless he is protected by the court after going through the pleadings and documents filed on record and after asking into consideration oral submission made before the court, I am of the view that a case for grant of interim relief is made by the plaintiff.
Hence, the defendant is directed not to create third party interest in the suit property till next date.
Since the defendant and his counsel are absent today, Ld. counsel fore the plaintiff is directed to comply by the provisions of Order 39 Rule (3) of CPC and communicate this order to the defendant for information and necessary compliance.
