The suit is pending for submission of draft issues after the pleadings have been completed long back and thereafter attempts for amicable settlement between parties had been undertaken and some consensus had been arrived at by filing the consent terms and reading them over for verification and confirmation before the court by parties at Exhibit-6. As per the agreement between parties suit property is to be sold to a prospective purchaser bidding highest consideration. It seems from roznama dated 06/01/2025 that the plaintiff has secured a prospective purchaser who is ready to purchase a property for 1 CR 20 lakhs and thereafter the defendants have been afforded opportunity to accept a proposal or to produce proposal of any prospective purchaser bidding higher than the said consideration. However, yet no further steps have been taken by the defendant to produce any highest bidder. The plaintiff is therefore requested to place on record name address and other details of prospective purchase secured by him and then parties shall proceed for execution of the registered sale deed in his favour as agreed in consent terms at Exhibit-6. Considering the facts and circumstances the matter does have element of settlement. Hence, it is refereed for finalization of terms of settlement after the compliance of the consent terms at Exhibit-6.
This is a fit matter for being referred to mediation for nation-campaign launched by the Hon’ble Supreme Court and NALSA New Delhi. Hence, the matter is refereed for mediation through the co-coordinator– Secretary DLSA Gr. Bombay. Issue referral order accordingly.
