corporation. ORDER The plaintiff has alleged that in view of
impugned notice dt. 02.01.2018, he is likely to be disposed
of the suit property. The plaintiff has relied on the documents
contending that his possession is prior to 01.01.95. The
officer of the corporation submits that only intimation is
given, and no order is passed as yet relating to unauthorized
structure. As per settled law, the corporation has to proceed
against the suit structure by passing suitable order only.
Considering this position the defendant shall pass appropriate
order, after considering the reply filed by the plaintiff, and
till then, shall not proceed for action against the plaintiff, and
for 1 week after passing of the order, if it is adverse to the
plaintiff.
