O R A L O R D E R
Read application. Heard both the sides.
2 By the present application, the applicant is seeking transfer of Suit
No.9608/90 from C.R. no.13 to any court established for senior citizens.
3 It is contended that the matter is pending on the file of C.R. no.13.
It is also contended that defendant no.19 is aged about 80 years- a senior citizen.
It is also contended that two courts have been established for disposal of the
cases of senior citizens i.e. C.R. no.7 and 9. It is contended that as defendant

no.19 is senior citizen, he prayed for transfer of matter to any of the court
established for senior citizens.
4 The learned advocate for plaintiff submitted that the matter is
already part-heard. However, he submits that suitable order be passed.
5 Since the two courts have been established for disposal of cases of
senior citizens and defendant no.19 is senior citizen, it is desirable that this
matter be heard by the court established for disposal of cases of senior citizens.
In comparison to C.R. no.7, C.R. no.9 has less cases. Therefore, the matter be
transferred to C.R. no.9. Hence, the following order:
O R D E R
1) Transfer Application No.04/2020 is allowed.
2) S.C. Suit No.9608/90 (High Court Suit no.348/90) is
withdrawn from C.R. no.13 and transferred to C.R. no.9 for
disposal in accordance with law.
3) Concerned courts be informed accordingly.
