ORDER IN N/M NO.57/20
Heard. This N/M is tendered by plaintiff for condoning the delay of 1753 days in filing the review
petition. Ld. Counsel for plaintiff submitted that the delay is unintentional and the plaintiff were
not aware about the final plot number and therefore, it was not incorporated in the plaint and hence,
it does not find place in the judgment and decree. The original deft. expired. His L.R.'s are made
party to present N/M. They have no objection for condoning the delay. In view of the matter, the
plaintiff has made out the sufficient cause for condoning the delay. Hence, it is expedient to pass
the following order.
ORDER
1. N/M no.57/20 is made absolute in terms of prayer clause (a) subject to cost of Rs.2,000/- to be
deposited with legal aid within a period of two weeks from today.
2. Payment of cost is subject precedent.
3. On payment of cost, the review petition be registered.
4. N/M no.57/20 is disposed off accordingly.
The matter is adjd for compliance to 30.01.2020.
