1. Heard Learned Advocate for the plaintif and Learned
Advocate for the defendant corporation.
2. The plaintif by this notice of motion seeks restoration of
draft notice of motion which was dismissed for want of
prosecution.
It is contended that the notice of motion is dismissed
because of bonafde mistake.
3. The notice of motion is opposed by the defendant

corporation. It is contended by the corporation that the suit
premises is partly demolished.
Considering the bonafde mistake on the part of the
plaintiff, the draft notice of motion is restored. In the resultf,
following order is passed.
ORDER
1. The Notice of Motion No. 49/2019 is allowed.
2. The Draft Notice of motion is restored.
3. The Notice of Motion No. 49/2019 stands disposed of.
