Order on Chamber Summons No. 06/2020
The plaintiff filed this Chamber Summons to condone the delay for filing Chamber
Summons and bringing on record the legal heirs of Deft.no. 6a. The Deft.no.6a is
expired on 20.01.2019 and defendant no. 7 is the only the legal heirs of deft.no.6a
and pray to allowed the Chamber Summons. The defendant no. 1 raised objection
that the Chamber Summons is not within limitation. Deft.no. 7 also raised objection
to grant the Chamber Summons. The plaintiff have ample time to brought on record
the legal heirs and Chamber Summons not within limitation and pray for dismissed
the Chamber Summons. Considering nature of Chamber Summons it appears that
the plaintiff wants to bring on record the legal representative who is already on
record to avoid technical defect. It will not affect right of defendant. Therefore,
there is no any harm to allow the Chamber Summons No. 06/2020
Order.
1. For the interest of justice Chamber Summons no.06/2020 is allowed.
2. Plaintiff is directed to carry out amendment before the next date.
