ORAL ORDER
This is a chamber summons taken out by plaintiff for
amendment in plaint. It is requested to correct the name and address of
defendants.
2. The learned advocate Kirti Gardi for plaintiff submits that
defendant is a proprietor of Sri Vinayaga Industries, Coimbatore.
However, there are different two companies of the same name situated
at different address and different proprietor. It was learnt to plaintiff in
respect of wrong person is made defendant, it is prayed for amendment
and proposed defendant be added as defendant with correct name and
address. It is also urged the previous defendant Mr. S. Senthil Kumar

be deleted from the plaint.
3. There is proper service of notice to the proposed defendant.
There is intimation on Email of the proposed defendant. The plaintiff is
master of the suit. It appear to be clerical mistake and negligence on the
part of plaintiff. Hence, the chamber is allowed to rectify the mistake.
Hence, the order.
FINAL ORDER
1. The Chamber Summons No.07 of 2019 is allowed.
2. The amendment as prayed be carry out by the plaintiff
within one months from the date of this order.
3. The Chamber Summons No.07 of 2019 disposed of
accordingly.
