motion no. 9/2019 alongwith affidavit. Adv. Hasan Khan
for D-1 present. Notice of motion no. 9/2019 is filed by D-
1 praying for permission to file written statement and
condonation of delay of 910 days. The plaintiff has filed
reply to the notice of motion. Heard both sides in NM
no.9/2019. Ld. Counsel for plaintiff submits that cost be
imposed if this Court is inclined to accept the written
statement of D-1. In view of the fact that D-1 is a formal
party, the notice of motion no. 9/2019 is allowed subject to
payment of cost of Rs.1000/- to plaintiff. Cost of Rs.1000/-
paid to the plaintiff before the Court. Hence written
statement is taken on record and the Ld. Counsel for
defendant no.1 is permitted to cross examine the plaintiff.
PW-1 resumed on SA. Cross examination of PW-1 by Adv.
Khan for D-1 is concluded. Ld. Counsel for plaintiff filed
Evidence Closure Pursis.
