Perused N/m and documents. Heard both the sides. Today Mr.Suhas Jadhav Jr.Engineer, M East Ward is present.  In the present case the MCGM has passed the speaking order on 26.12.2017.  Admittedly, the speaking order was passed by the concerned officer without considering the reply filed by the plaintiff on 26.12.2017 and 28.12.2017 through advocate.  The officer present before the court has made a statement that the MCGM will considered the reply and documents filed by the plff.and will pass the fresh speaking order.   As such, no purpose would be served in keeping this N/m and suit pending.   The MCGM to pass the fresh speaking order and shall communicate the same to plaintiff in writing.  If the order is against the plaintiff, then no coercive action will be taken for a period of one week. All the issues are kept open.  Accordingly N/m No.24/2018 stands disposed of accordingly.
