Vide order no. Judl.II/F102/South/Saket/2023/
22821-22850 dated 31.08.2023 issued by The Ld. Principal
District and Sessions Judge, South, this court has been
authorised u/s 10 (3) of the Cr.P.C. to dispose of bail/urgent
applications pertaining to the police stations/investigating
agencies as mentioned in the said office order.
These are two applications u/s 438 CrPC seeking
anticipatory bail moved on behalf of applicants/accused.
Present : Shri Arun Kumar Singh, Ld. Addl. PP for State.
Sh. Arvind Rana, Ld. Counsel for applicants/accused
ASI Sarabjeet Singh is present.
Reply filed by IO. Copy be supplied.
As per reply of IO, the applicants were served with
notice u/s 41A CrPC to join investigation but they did not come
to join the investigation till date and when Kapil was contacted
on phone, he made some or other excuse.
Ld. Counsel for applicants states that applicants are
ready and willing to join the investigation.
On inquiry, IO has informed that offence u/s
498A/406 IPC is alleged against the applicants.
The applicants are directed to join the investigation
before next date of hearing in the bail applications.
The case of the applicants is covered under the
judgment of Arnesh Kumar passed by Hon'ble Supreme Court.

Subject to joining of investigation, interim protection is
granted to the applicants till next date of hearing and no
coercive action be taken against the applicants.
Let notice be issued to the complainant through IO
and notice be issued to the IO to file further investigation report
on 27.09.2023.
Copy of order be given dasti to all concerned.
Order be uploaded on the Saket District Court
website.
