Present AR with counsel for complainant.
Sh.Pankaj Bhatty, AR/Manager (Legal) examined himself as
CW1. Sh.G.K.Sharma lineman examined himself as CW2 by way of
affidavit. The counsel for the complainant has stated that no further witness
is to be examined on behalf of complainant and as such presummoning
evidence is hereby closed.
Arguments heard.
In the complaint Ex.CW1/1 and evidence on record i.e.
Ex.CW2/A to Ex.CW2/G, it is mentioned that accused was found
committing theft of electricity by way of direct theft of electricity in the
premises in question as mentioned in inspection report. Hence, I am of the
considered opinion that there are sufficient grounds to proceed against the
accused for the offence punishable u/s 135 of Electricity Act, 2003.
Let summons be issued to the accused Anita & Suraj through
SHO PS Mehrauli, New Delhi along with dasti summons to be served by
one of the Raiding Team Members on filing PF for 27.07.2023.
