Present: Mr. Himanshu, Ld. Advocate for the DH.
The present execution application has been filed
within two years from the date of the judgment,however, ex-parte
judgment/decree had been passed against the JD. Therefore, the
court is of the view that notice be issued to the JD of the present
execution application before proceedings for recovery/execution
of the decreetal amount.
Notice is issued to the JD at all the addresses on
filing of PF, Postage, within the next seven days returnable on the
next date of hearing.
Service be also effected by way of Registered Post,
AD, Speed Post and authorized courier. The DH is directed to file
tracking report with the postal receipts and the supporting
affidavit/certificate on the next date of hearing. The e-mail
address and mobile no./contact no. be also furnished with the PF
and notice be served to the JD also by way of e-mail/whatsapp
and the DH is directed to file the supporting documents with
relevant affidavit on the next date.
In case the JD refuses to take service of the notice or
the is not found available at the given addresses, the serving
officer is directed to affix a copy of the notice on the outer
door/conspicuous part of the premises and this be mentioned
specifically on the notice (taken by way of ordinary process).
