DEVENDER KUMAR /0 (Anand Vihar Railway Station) 03.09.2026 Second stenographer of this court is on leave today and no substitute stenographer is provided today. Present: Sh. Mukesh Sharma and Sh. Nikhil Dogra, Ld. counsels for the complainant. EO/SI Brij MOhan in person. Clarifications sought from the IO. EO submits that he was transferred in January 2025 and the case file was handed over to Reader of the SHO. Upon inquiry, EO submits that the notice u/s 94 BNSS is on record in the case file and the notice had been received by the mother of the complainant. EO also submits that interrogation report of proposed accused persons is also in the file. Lastly, EO submits that the complainant did not join the investigation despite efforts of the EO. Per contra, Ld. Counsel for the complainant submits that proper investigation has not been conducted in the present case. He further submits that the complainant is 90% disabled. Ld. Counsel for the complainant further submits that there are incorrect submissions made by the EO regarding filing of a civil suit which was actually filed by the complainant against the proposed accused whereas the EO has wrongly noted that the proposed accused persons filed a civil suit against the complainant. Heard. Perused. Considered. Let SHO concerned be summoned for providing clarifications and a new EO be deputed in the present case since the previous EO has been transferred. Part arguments heard.
