Accused is absent.
Summons to accused received back served through WhatsApp.
However, he has not appeared.
Report perused.
Perusal of the file shows that the present matter has been settled
between the parties in the sum of Rs. 89,000/- out of which Rs. 4000/- has
been paid by accused to the complainant and further on 13.03.2026 accused
submitted that he shall pay the balance of Rs. 85,000/- within 5 months.
However, he has not made the balance amount till date.
Despite repeated calls, none has appeared on behalf of accused.
Record perused.
It is already 12:55 pm.
No reasons have come forward for the non appearance of
accused.
Accordingly, issue NBW against accused through SHO
concerned on filing of PF within 15 days from today, returnable on
NDOH.
Concerned Police official is directed to make at least three
attempts to execute the same.
Complainant is at liberty to accompany with the Process
Server at the time of execution of process.
Put up for appearance of accused/furnishing of bail/framing of
notice on 06.10.2026.
